Constitutional Court declared illegal law on All-Ukrainian referendum

The Constitutional Court declared illegal the law on the All-Ukrainian referendum, as Vasyl Lemak, the reporting judge on the case, wrote on Facebook.
He informed that his draft decision was supported by all the judges of the Constitutional Court.  
“It is not about a particular law admitted unconstitutional (the law on the All-Ukrainian referendum). It is about a series of legal positions of Ukraine’s Constitutional Court, which make them (such laws) impossible,” he stated.

The judge considers this decision of the Constitutional Court fundamentally important.
In its turn, the press-office of the Constitutional Court reported that the law was declared unconstitutional due to the irregularities of procedure and regard its content.
The court has decided that this law is in total contradiction to the Constitution.
The Constitutional Court noted that a nonpersonal voting of the people’s deputies was documented in the voting for the law on the referendum in the Verkhovna Rada.
The Constitutional Court noted that having adopted the law he Parliament expanded beyond its constitutional authorities.
The law on the All-Ukrainian referendum expired when the Constitutional Court made the decision.
The decision is compulsory and final, no appeal is possible.

Earlier, the Constitutional Court started considering the validity of the law on the All-Ukrainian referendum in March 2016.
The Constitutional Court received the presentation of 47 MPs in December 2014.
The deputies ask the Constitutional Court to declare the law on the All-Ukrainian referendum unconstitutional as they think that the Parliament exceeded its authority adopting it on June 6 in 2012.
