Prosecutor's office opens case against unjust decision in Kernes’ case

Prosecutor's office in Poltava region opened a criminal proceeding against the decision of the Kyiv District Court of Poltava, which decided to dismiss the criminal case against the Mayor of Kharkiv Hennadiy Kernes, and his guards Vitaly Blinnik and Yevhen Smitsky. Anzhela Stryzhevska, Deputy of the Prosecutor General of Ukraine claimed this at a briefing, 112 Ukraine reports.
‘Information on the judge's deliberately making an unjust decision are included in the Unified register of pre-trial investigations in Ukraine. It was conducted by the Prosecutor's office in Poltava, and the Prosecutor General’s office will include such information to the unified register. The organization, holding of the pre-trial investigation will be requested to the relevant body of pre-trial investigation,’ she said.

 Stryzhevska explained that it is planned to combine these two cases.
‘As far as I watched the information in the Unified register of pre-trial investigations in Ukraine, the Prosecutor's office in Poltava region included them on the basis of the message of mass media. Now, we have a report of the Prosecutor that the information reflected in the court is not true. According to the Prosecutor, the decision is unjust. In order to verify these arguments, a pre-trial investigation will be organized,’ she summed up.

Reportedly, today, Kyiv District Court of Poltava decided to close the criminal case against the Mayor of Kharkiv Hennadiy Kernes, and his guards Vitaly Blinnik and Yevhen Smitsky.
Later, the Prosecutor General’s office stated on the intention to appeal today’s decision of the court.
Reportedly, a group of people attacked the participants of the march in support of the Euromaidan in Kharkiv on January 25, 2014. The same day, Ivan Varchenko, MP of Kharkiv Regional Council stated on the kidnapping of Oleksandr Kutianin and Serhii Riapolov, the participants of the Euromaidan, after they disassembled the license plates of Kernes’ friends’ cars. Later, the Public Affairs Division of the State Administration of Ukrainian MIA in Kharkiv region claimed that the information on the kidnapping wasn’t confirmed.

On April 2, 2015, The Supreme Court of Ukraine announced the operative part of the decree on the transfer the review of Kernes’ case from the Dzerzhinsky district court of Kharkiv to the Kyiv district court of Poltava, where it was considered before the adoption of today's decision.
